Terms of Use

Google Inc. is operating the Street View camera loan program (the “Program”) where it will loan a 360 camera (the “Camera”) to eligible applicants to capture images and upload them to Google Maps and Street View (the “Service”). In order to participate in the Google Street View camera loan program, participants (“you” or “your”) agree to the following terms (the “Terms of Use”):

Eligibility for the Program:

  1. Eligible Applicants. Google will review the applications submitted and in its sole discretion determine an applicant’s eligibility for the Program. Only persons submitting an application on their own behalf or on the behalf of an organization for which they have authority to submit an application will be considered.
  2. Ineligible Applicants. Persons who are (a) residents of US embargoed countries, (b) ordinarily reside in US embargoed countries, (c) otherwise prohibited by applicable export and re-export control laws and regulations, (d) or under the age of 18 may not participate in this program.
  3. Business uses of our services. If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify Google and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorney’s fees.
  4. Mobile App Download. To participate in the Program, you must first download the Google Street View mobile app (available in Google Play and the Apple iTunes App Store) to your mobile device. If you cannot download the Street View app, you will not be eligible for the Program. Do not use such Services in a way that distracts you and prevents you from obeying traffic or safety laws.

Application to the Program:

  1. Consent. By applying to the Program, you consent to:
    1. Google’s use of the information you provide in your application to manage and operate the Program, including maintaining your contact information for a reasonable period of time after your loan term is complete, as set forth in the Google Privacy Policy;
    2. Google’s use of the information you provide to Google in your application, including in promotional or marketing materials about the Program; and
    3. receiving emails from Google about the Program at the email address you provide.
  2. Contact Information. Your application to the Program must include your current contact information. If your contact information changes after you have submitted your application, you must provide Google with your updated information in order to remain eligible for the Program.
  3. Number of Cameras:
    1. Your loan application is for a single Camera.
    2. You may request to borrow more than 1 Camera in your application, subject to Google’s discretion.
  4. Logistics and Shipping:
    1. You will provide a shipping address that’s either a business or personal residence in your application. You must be authorized to receive mail at this address and it must be located in the country listed in your application.
    2. You must follow Google’s instructions to receive and return the Camera.
    3. Google will pay for all shipping costs between you and Google if you comply with Google’s instructions.
  5. False Information. We may suspend your participation in the program if you do not comply with these terms or if we are investigating suspected misconduct, including providing false information in your application.

If you are selected, the following will apply:

  1. No Use of Camera by Others. You will restrict any other individuals or others outside your organization from using the Camera. You may not lend or loan the Camera to anyone else during the term of your loan.
  2. Use Outside the Approved Country. If you travel with the Camera, you are responsible for any and all costs and requirements associated with that travel, including any import/export costs and requirements.
  3. Minimum Imagery. You will use the Camera to photograph at least the site and scope referenced in your application.
  4. No Employment or Contractor Relationship:
    1. You will not portray yourself as a Google employee, agent, or contractor as a result of your participation in the Program. You will at all times clearly represent to third parties that you are acting on your own behalf. You acknowledge and agree that you have no authority (other than as expressly set out in these Terms of Use) to bind Google, enter into agreements on behalf of Google or to make representations on behalf of Google. You acknowledge and agree that breach of this Section would cause Google irreparable harm and that, in addition to any other available remedies, and without prejudice to Google’s remedies for breach of any other Section of these Terms of Use, Google may seek immediate injunctive relief for breach or prospective breach of this Section.
    2. If you use the Camera as part of the Trusted photographer program, you must abide by the Trusted photographer sales and branding guidelines.
  5. Applicable Law and Permissions.
    1. You will comply with (i) local laws when you capture imagery; and (ii) the Maps photo & video policy when you upload imagery to Google via the Street View app.
    2. If applicable, you will obtain any required permissions (for example, permission required to access a location or photograph in that location) on your own, without Google’s intervention or support.
  6. Ownership and Use of Images.
    1. You own the images you create when using the Camera. The images that you upload via the Street View app will be subject to the Google Privacy Policy and the Google Terms of Service, including the section titled “Your Content in our Services”.
    2. You may use the Camera to perform photography services on behalf of a third party who has hired you to do so. You may also sell the images that you capture.
    3. Prior to returning the Camera to Google, you will delete all images from the Camera. Google is not responsible for any images that you leave on the Camera.
  7. Loan period.
    1. The loan period is 45 days from receipt of the Camera, unless extended in accordance with Subsection (b).
    2. Prior to the end of a loan period, Google may contact you about extending your loan. To determine whether to extend your loan, Google may require you to provide additional information, including a description of:
      1. your use of the Street View app during the loan period, including number of photographs taken and published; and
      2. your reasons for requesting additional use of the Camera.
    3. If Google extends the loan period, these terms will continue to apply.
    4. You may ship the Camera back at any time during, but no later than the last day of, the loan period.
    5. If you do not return the Camera at the end of the loan period, Google may terminate your participation in the Program and, if applicable, take other actions such as revoking your Trusted status.
  8. Caring for the Camera while in your Control or Possession.
    1. The Camera includes: a camera (including all materials provided by the manufacturer) and a case. In some cases, extra batteries, a battery charger, a Micro SD card, a monopod, a mini-tripod, a tripod, or a helmet mount will be included.
    2. Upon receipt, the Camera is your responsibility. Google understands that Cameras will experience general wear and tear from use. You will make reasonable efforts to maintain the Camera in the condition in which you receive it during the loan period.
    3. If you are no longer able to use the Camera during the loan period due to equipment loss, theft, or breakage, you must immediately notify Google by writing at streetview-loan@google.com and describe your issue in detail.
      1. If Google determines that you negligently or intentionally caused damage to the Camera, Google may hold you liable for the damage in accordance with the applicable law.
      2. Google may send a replacement for a damaged Camera in its sole discretion.
    4. You will not acquire any ownership or other rights to the Camera or any accessories provided to you, except the right to possess and use them in accordance with these terms, including ownership of any intellectual property rights or the content you access through the program. These terms do not grant you the right to use any branding or logos used in Google's Services.
  9. Use at Your Own Risk; Hold Harmless. Subject to Section 20, your use of the Camera is at your own risk. You will hold Google harmless for any damage to your property or a third party’s property during your use and transportation of the Camera.
  10. DISCLAIMERS.
    1. OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS, NEITHER GOOGLE NOR ITS SUPPLIERS OR DISTRIBUTORS MAKE ANY SPECIFIC PROMISES ABOUT THE CAMERA OR THE PROGRAM. FOR EXAMPLE, WE DON’T MAKE ANY COMMITMENTS ABOUT THE SPECIFIC FUNCTIONS OF THE CAMERA, OR ITS RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE CAMERA “AS IS”.
    2. SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES OR CONDITIONS, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, COMPLIANCE WITH DESCRIPTION AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES.
  11. LIMITATIONS OF LIABILITY.
    1. WHEN PERMITTED BY LAW, GOOGLE, AND GOOGLE’S SUPPLIERS AND DISTRIBUTORS, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
    2. TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF GOOGLE, AND ITS SUPPLIERS AND DISTRIBUTORS, FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE VALUE OF THE CAMERA.
    3. IN ALL CASES, GOOGLE, AND ITS SUPPLIERS AND DISTRIBUTORS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.
    4. NOTHING IN THESE TERMS WILL EXCLUDE OR LIMIT GOOGLE’S LIABILITY (HOWSOEVER ARISING, INCLUDING FOR NEGLIGENCE) FOR: (I) DEATH OR PERSONAL INJURY RESULTING FROM ITS NEGLIGENCE OR THE NEGLIGENCE OF ITS EMPLOYEES OR AGENTS; (II) FRAUD OR FRAUDULENT MISREPRESENTATION; AND (III) ANY LIABILITIES WHICH CANNOT BE EXCLUDED OR LIMITED BY LAW.
  12. Governing Law. The courts in some countries will not apply California law to some types of disputes. If you reside in one of those countries, then where Californian law is excluded from applying, your country’s laws will apply to such disputes related to these terms. Otherwise, you agree that the laws of California, USA, excluding California’s choice of law rules, will apply to any disputes arising out of or relating to these terms or the Services. Similarly, if the courts in your country will not permit you to consent to the jurisdiction and venue of the courts in Santa Clara County, California, USA, then your local jurisdiction and venue will apply to such disputes related to these terms. Otherwise, all claims arising out of or relating to these terms or the services will be litigated exclusively in the federal or state courts of Santa Clara County, California, USA, and you and Google consent to personal jurisdiction in those courts. These terms control the relationship between Google and you. They do not create any third party beneficiary rights. If you do not comply with these terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future). If it turns out that a particular term is not enforceable, this will not affect any other terms.
  13. About these terms. We may modify these terms or any additional terms that apply to the Program. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. Changes will not apply retrospectively and will become effective no earlier than fourteen days after they are posted. However, changes made for legal reasons will be effective immediately. If you do not agree to the modified terms, you should discontinue your participation in the Program.
